By visiting our site, browsing our products, or placing an order, you're agreeing to the terms below. Please read them carefully, they explain what you can expect from us, and what we expect from you. Think of it as the recipe for a great relationship!
If you don't agree with these Terms of Service or with our Privacy Policy, please don't use the site or place an order. (But we hope you stick around!)
When we say "Caffeine Dept.", "we", "us", or "our", we're talking about Caffeine Dept. When we say "Services", we mean this website, our online store, and everything we offer through them.
1. Access and Account
You must be the age of majority where you live to use our Services, or you must have permission from a parent or guardian. (No sneaking coffee before you're ready!)
To shop with us, you may need to provide certain info, like your name, email, shipping address, and payment details. You promise that all the information you give us is accurate, current, and complete, and that you're allowed to use that payment method.
If you create an account, you're responsible for keeping your login details safe and for everything that happens under that account. Please don't share or sell your account to anyone else. Guard it like your favorite coffee mug!
2. Our Products
We try to show our products honestly, style, colors, prints, the whole espresso shot! But please understand that colors and appearance can look slightly different on different screens, lighting, or device settings. (It's kind of like how coffee looks different in different lighting!)
We don't guarantee that every product will look exactly the same in real life as it does on your screen, or that it will meet every personal expectation.
We can update product descriptions, pricing, features, or availability at any time. We can also limit or stop offering certain items, including limiting orders by location, person, or order quantity. (Sometimes the beans run out!)
3. Orders
When you place an order, you're making an offer to buy, like ordering your favorite brew at the coffee shop! We reserve the right to accept or reject that order.
Your order is considered accepted once (1) payment has been processed and (2) we confirm the order. Until then, we can decline or cancel an order for reasons like payment issues, inventory problems, or suspected fraud. If we cancel or change an order, we'll try to contact you using the email, billing address, or phone number you gave us.
Please double-check your order before submitting it. We may not be able to change or cancel it after it's confirmed, just like you can't un-order that extra shot of espresso!
Any returns, refunds, or order issues are handled under our Return & Refund Policy. You confirm that what you buy is for personal use only, not for resale or export.
4. Prices and Billing
Prices can change at any time, without notice, kind of like coffee prices at your local café! The price you see at checkout is the price that applies to your order, and it will also appear in your order confirmation email.
Unless we clearly say otherwise, prices do not include taxes, shipping, customs, or import fees. Those may be added at checkout or charged separately by your country's customs.
We sometimes run promotions, sales, or discount codes. These may have their own terms. If there's a conflict between a promo's terms and these Terms, the promo terms control for that promo.
You agree to provide accurate, up-to-date billing information (including valid payment details and a working email address), and to update it if anything changes so we can complete your order and contact you if needed.
By checking out, you confirm that the payment method is yours (or you're authorized to use it), the info you gave us is correct, your bank will approve the payment, and you'll pay all charges shown (including taxes, shipping, and fees).
5. Shipping and Delivery
We'll prepare and ship your order as described in our Shipping Policy. Delivery times are estimates and are not guaranteed, think of them like waiting for your coffee to brew, sometimes it takes a little longer!
Once your order is handed to the carrier, the package is in transit and risk of loss passes to you. We aren't responsible for delays caused by carriers, customs, weather, or events outside our control. (We wish we could control the weather, but we can't!)
If something arrives damaged or doesn't arrive, contact us. We'll work with you to make it right!
6. Intellectual Property
Everything on our site, designs, logos, product names, graphics, photos, videos, text, layout, and so on, belongs to Caffeine Dept., our partners, or our licensors. It's protected by intellectual property laws, like a secret coffee recipe!
You're allowed to browse the site and shop for personal, non-commercial use. You are not allowed to copy, reproduce, edit, re-upload, resell, publicly display, or reuse our content without written permission.
"Caffeine Dept." and related names, logos, designs, and slogans are trademarks of Caffeine Dept. Shopify's names and logos are trademarks of Shopify. Other names and logos belong to their owners. You may not use any of these without permission.
7. Optional Tools
Sometimes we may give you access to tools or features from third parties (for example, reviews, order tracking widgets, personalization, etc.). These are offered "as is" and "as available", like trying a new coffee blend!
We don't control those tools, and we don't guarantee how they work. If you choose to use them, you do so at your own risk and you should read the third party's terms.
We may add new tools or features in the future. Those are also covered by these Terms.
8. Third-Party Links
Our store may link out to other websites or services that we don't own or control, kind of like recommending your favorite coffee roaster!
We are not responsible for reviewing or guaranteeing the accuracy, content, policies, or security of those third-party sites. If you click through and use their site, you're doing that under their terms, not ours.
If you have an issue with a third-party product or service, you'll need to contact that third party directly.
9. Relationship with Shopify
Caffeine Dept. is powered by Shopify. Shopify provides the ecommerce platform that runs our storefront, checkout, and certain security and payment technologies, they're like the espresso machine that powers our operation!
However, when you buy from us, you are buying from Caffeine Dept., not Shopify.
By using our store, you agree that Shopify is not responsible for your order, product quality, shipping, returns, refunds, exchanges, or any damages or losses related to your purchase. You agree that Shopify and its affiliates are released from any claims related to your transactions with us.
10. Privacy
We collect and use personal information in line with our Privacy Policy [LINK]. Please read it, it explains what data we collect, why we collect it, and your rights. (We keep your info safer than your secret coffee order!)
Because our store is hosted on Shopify, Shopify may also collect and process information about how you use our site, for security, fraud prevention, analytics, and to help power your checkout experience. Some of that data may be stored or processed in other countries.
By using our Services, you agree to our Privacy Policy and acknowledge Shopify's role in processing certain information.
11. Feedback (Reviews, Ideas, Suggestions)
If you send us any feedback, reviews, ideas, suggestions, design ideas, messages about what we "should make next," etc., you're telling us we're allowed to use that feedback. We love hearing from you!
Specifically: by submitting feedback, you give Caffeine Dept. a worldwide, royalty-free, permanent license to use it, modify it, publish it, promote it, and make products or content from it, without owing you anything.
You also agree that you have the right to share the feedback, you're not pretending to be someone else, and your feedback doesn't break any laws or violate anyone's rights.
We may, but don't have to, monitor, edit, or remove content we think is inappropriate. You are fully responsible for anything you post or submit.
12. Errors and Information
Sometimes there may be a typo, missing info, or incorrect detail on the site, like pricing, promotions, availability, or shipping times. (Even baristas mess up orders sometimes!) We reserve the right to correct any errors, update information, or cancel orders if something on the site was inaccurate, even after you've already placed an order.
13. Prohibited Use
You agree to use our Services for legal, respectful, normal shopping behavior, basically, just be cool! ☕
You agree not to: use the Services for anything illegal or harmful; harass or abuse anyone; pretend to be someone you're not; send spam or malicious code; copy or scrape our content for your own commercial use; try to get around security; or upload content that is hateful, threatening, or violates someone else's rights.
We reserve the right to suspend or block access if you misuse the Services.
14. Termination
We can suspend or end your access to the Services at any time, for any reason, without notice, for example, if we believe you violated these Terms.
Some parts of these Terms will still apply even after termination. This includes sections about intellectual property, warranties, liability, indemnification, dispute handling, and privacy.
15. Disclaimer of Warranties
Unless we say otherwise in writing: the site, the Services, and all products are provided "as is" and "as available."
We do not promise that using the site will be uninterrupted, secure, error-free, or that everything will always be accurate or up to date. (We're good, but we're not perfect!)
We disclaim all implied warranties to the fullest extent allowed by law, including fitness for a particular purpose, non-infringement, and merchantability. Some places don't allow certain disclaimers, so parts of this may not apply to you depending on where you live.
16. Limitation of Liability
To the fullest extent allowed by law, Caffeine Dept. (including our owners, directors, employees, partners, agents, and service providers) is not responsible for indirect, incidental, special, consequential, or punitive damages. This includes lost profits, lost data, lost savings, replacement costs, or similar losses, even if we were told it could happen.
Some places don't allow limits like this. If your local law requires a different standard, that standard applies.
17. Indemnification
You agree to defend and hold harmless Caffeine Dept., Shopify, and our teams, partners, and service providers against any claim or demand (including reasonable legal fees) made by a third party that comes from: your use of the Services; your violation of these Terms; or your violation of someone else's rights or the law.
We may take control of the legal defense in such cases. If we do, you agree to cooperate.
18. Severability
If any part of these Terms can't be enforced, that part will be limited or removed as allowed by law. The rest will still apply, like removing the burnt beans from the batch and keeping the good ones!
19. Waiver and Entire Agreement
If we don't enforce part of these Terms, that doesn't mean we've waived our right to enforce it later.
These Terms, plus any policies we link (like the Privacy Policy and Return & Refund Policy), are the full agreement between you and us. They replace any older versions.
Headings and section titles are there to make this easier to read. They don't change the meaning.
20. Assignment
You may not transfer your rights or responsibilities under these Terms to anyone else without our written permission. We may transfer our rights and obligations under these Terms at any time.
By continuing to use the Services after such a transfer, you agree to the transfer.
21. Governing Law
These Terms and any disputes between you and us are governed by the laws and courts of the location where Caffeine Dept. is headquartered. By using the Services, you agree to that location's courts having jurisdiction.
22. Changes to These Terms
We can update these Terms of Service from time to time, just like updating our coffee menu! When we do, we'll update the "Last updated" date at the top of this page.
Your continued use of the site after changes are posted means you accept the updated Terms. If a change is legally considered "material," we'll follow any notice requirements that apply.
